דף היומי סיכום — Chullin 11

די איבערזעצונג איז נאָך נישט גרייט. דער ענגלישער סיכום ווערט געוויזן.

Chullin 11 – Good Morning Raboisai Two Types of Rov The Gemara establishes two types of rov (majority) • Rov that is countable (in front of you) : o Beis Din (12 vs 11) o 9 kosher shops vs 1 non - kosher This is clearly from the Torah • Rov that is not countable : o Not visible o Based on general reality Main question of the sugya: • Where is the source for this type? Case – Yibum with a Minor • One party is a minor • Concern: maybe he will later be unable to have children If so: • Yibum would be invalid Yet we allow it: • Because: We rely on rov (most people are capable) Question: • What is the source for relying on such a rov? Ten Proof Attempts – and Why Each Fails The Gemara brings a series of cases to prove rov — each is rejected: 1. Daily Korban (Head of the Animal) • Concern: maybe the brain membrane has a hole → animal is treifa • Cannot break the head to check Rejection: • Maybe they checked in another way (opened carefully without invalidating it) 2. Korban Pesach • Cannot break bones → cannot inspect internal defects Rejection: • Could burn through the skull and check • Burning is not considered breaking 3. Fat Tail (Aliyah) • Removing it might sever the spinal cord → treifa Rejection: • Maybe it was cut in a place where it does not cause treifa • Or possibly checked afterward 4. Eglah Arufah • The calf might be a treifa Rejection: • Special דין of kaparah — not a general proof 5. Parah Adumah • Must be complete and not treifa Rejection: • It lived 12 months → already has a chazakah it is not treifa 6. Yom Kippur Goats • One goat might be treifa Rejection: • Requirement is only that it be fit initially • Not proof for rov 7. Killing a Murderer • Maybe the victim was already a treifa • Killing a treifa does not carry death penalty Rejection: • Cannot perform autopsy (disrespect to the dead) • No proof from here 8. Identity of a Father • How do we know the father is really the father? Answer: • We rely on rov Rejection: • Case can be set up with certainty (e.g. no doubt scenario) 9. Additional Murder Scenario • Maybe the killing blow entered through an existing fatal wound Rejection: • Case can be constructed without such uncertainty (e.g. drowning) 10. Edim Zomemim (False Witnesses) • Maybe the victim was a treifa • Then witnesses should not be killed Rejection attempt: • Maybe we could check Final issue: • Cannot check (person must be alive for punishment) Strong Proof – Edim Zomemim Despite all concerns: • We still punish false witnesses Conclusion: • We rely on rov: Most people are not treifa Strongest Proof – Shechita • Torah says: Shecht and eat Concern: • Maybe knife cut exactly where defect already existed We do not check for this Therefore: • We rely on rov: Most animals are not treifa • Rashi says relying on רוב must be derived from הלכה למשה מסיני , or from אחרי רבים להטות . Key Rule from the Sugya When something can be checked → we check When something cannot be determined → rely on rov Practical Outcome • We do not check all possible defects (18 treifos) • We only check: o Common issues (like lungs) Everything else: • Relies on rov Key Takeaways • Two types of rov: countable and non - countable • Main sugya: source of non - countable rov • Ten attempted proofs — all rejected • Strongest applications: o Edim Zomemim o Shechita • Rule: o If checkable → check o If not → rely on rov • Final source: Halacha from Sinai • Practical halacha depends on rov Catch up, review, download previous Dafim & more: https://www.dafchazarah.co.uk Now available as an app (Apple, Google & Amazon): https://dafchazarah.co.uk/download Sponsor a day: https://dafchazarah.co.uk/sponsor To receive the daf summary daily join our group: https://chat.whatsapp.com/L4AiVVxQwYqLRh4RtMAlGE לעילוי נשמת אמי מורתי רות בת הרב מנחם מנדל
