Chullin 104 – Good Morning Raboisai New Perek – Basar B’Chalav Gemara: The new perek begins with the laws of: • Meat and milk The Mishnah says: • All meat may not be cooked with milk This includes discussion of: • Beheimos • Chayos • Chicken But: • Fish and grasshoppers are excluded Chicken and Milk – D’Oraisa or D’Rabbanan? The Gemara discusses whether cooking chicken with milk is: • A Torah prohibition • Or only Rabbinic According to Rebbe Akiva: • Chicken with milk is not prohibited by the Torah According to the Rabbanan: • It is prohibited mid’Oraisa A Neder Not to Eat Meat If someone makes a neder: • Not to eat meat Fish: • Is not included Chicken: • Can be included Why? Nedarim follow: • The way people normally speak If someone is sent to buy meat and there is none: • He may return and ask whether to buy chicken instead This shows: • Chicken can be included in the everyday meaning of “meat” Rebbe Akiva – The Shaliach Test Rebbe Akiva gives a general rule: If a person asks a shaliach to buy something and it is unavailable: • Whatever the shaliach would naturally suggest as an alternative can be included in that category Example: • Asked for meat → may suggest chicken • Asked for vegetables → may suggest pumpkin But something completely unrelated: • Is not included How Can the Mishnah Follow Different Opinions? Problem: The beginning appears: • Not to follow Rebbe Akiva The end concerning nedarim: • Does follow Rebbe Akiva Rav Yosef The entire Mishnah is: • Rebbe Rebbe rules: • Like the Rabbanan in the first part • Like Rebbe Akiva in the later part Rav Ashi’s Explanation Rav Ashi says: • The entire Mishnah can follow Rebbe Akiva The Mishnah includes all meat in the prohibition: • But not necessarily at the same level Regular meat and milk: • D’Oraisa Chicken and milk: • D’Rabbanan Meat and Milk on the Same Table The Mishnah prohibits placing: • Meat • Together with cheese On the table where one is eating. Gezeirah L’Gezeirah Rav Yosef initially argues: If chicken and milk were only D’Rabbanan: • Eating them together is already a gezeirah To prohibit merely putting them on the same table would then be: • A gezeirah upon a gezeirah Normally: • Chazal do not make a gezeirah l’gezeirah Proof from Challah Outside Eretz Yisrael Challah outside Eretz Yisrael is: • D’Rabbanan A Kohen may eat this challah in front of a Yisrael without the same concern that applies to Torah - level challah. We do not add another gezeirah because: • The original obligation itself is only Rabbinic Abaye Rejects the Proof Abaye says the cases are different. With chicken and milk: • One can easily move directly from chicken to real meat Therefore: • There is a realistic concern of reaching a Torah prohibition Cold Meat and Cold Cheese Question: If both foods on the table are cold: • There is no Torah prohibition of cooking So why prohibit putting them together? Answer The concern is: • One may eventually place them together in a hot kli rishon Then: • Actual cooking can occur Beis Shammai vs Beis Hillel Beis Shammai: • Chicken and cheese may be placed on the same table • But may not be eaten together Beis Hillel: • They may not even be placed together on the eating table Rebbe Yosi Rebbe Yosi says: • This is one of the six places where Beis Shammai are lenient and Beis Hillel are stringent Which Table? The prohibition applies to: • The table where the person is actually eating A separate serving or side table: • Is not included in this prohibition Rebbe Yosi’s Statement Question: • What does Rebbe Yosi add to the Tanna Kamma? Perhaps he means Beis Shammai even allow: • Eating chicken and cheese together The Gemara rejects this. Rebbe Yosi only means: • Beis Shammai allow them to be placed on the same table Not: • That they may be eaten together Saying Something in the Name of Its Source The Mishnah’s wording leads to the principle: • One should repeat a teaching in the name of the person who said it Esther said something: • In the name of Mordechai This teaches the importance of: • Giving proper credit for Torah Eating Cheese Before Chicken If someone eats: • Cheese And afterwards wants: • Chicken He does not require the same cleaning procedure needed before eating regular meat. Rav Yitzchak at Rav Ashi’s House Rav Yitzchak ate: • Cheese Afterwards they brought him: • Meat He ate without washing his hands. He was questioned: • Surely the leniency was only from cheese to chicken, not from cheese to actual meat? Day vs Night The Gemara distinguishes between: During the day: • A person can inspect his hands • If they are clean, washing may not be necessary At night: • He may not see food remaining on his hands Therefore: • He must wash them Final Points • The new perek begins the major sugya of basar b’chalav • Fish and grasshoppers are not included in meat • There is a machlokes whether chicken and milk is D’Oraisa or D’Rabbanan • For nedarim, chicken can be included in the normal meaning of meat • Rebbe Akiva uses the shaliach test to determine ordinary language • Rav Yosef and Rav Ashi explain how the different parts of the Mishnah fit together • The daf discusses the principle that we normally do not make a gezeirah l’gezeirah • Beis Shammai allow chicken and cheese on the same table, while Beis Hillel prohibit it • The restriction concerns the table where one is actually eating • Torah should be repeated in the name of the person who said it • The daf begins the practical laws of moving from dairy to meat • During the day one can inspect clean hands, while at night washing is required Catch up, review, download previous Dafim & more: https://www.dafchazarah.co.uk Now available as an app (Apple, Google & Amazon): https://dafchazarah.co.uk/download Sponsor a day: https://dafchazarah.co.uk/sponsor לעילוי נשמת אמי מורתי רות בת הרב מנחם מנדל
