Bechoros 22 – Good Morning Raboisai Rebbi Eliezer ben Yaakov – The Chararas Dam The Mishnah discusses a large animal that had never previously given birth, and then discharged a Chararas Dam – a mass or clump of blood. Rebbi Eliezer ben Yaakov says: • The Chararas Dam is buried. • The animal is now exempt from Bechorah. • Its next offspring is therefore not treated as its firstborn. We treat the discharge as evidence that there was already a Vlad But Why Is There No Tumah? The Beraisa teaches that the Chararas Dam: • Does not convey Tumah through Maga – touching. • Does not convey Tumah through Masa – carrying. This creates an obvious question. If the discharge contained a genuine Vlad, enough to exempt the mother's next offspring from Bechorah: Why isn't the dead Vlad treated as a Neveilah and Metamei? Why Must It Be Buried? The Gemara also asks: If it does not have Tumah, why must the Chararas Dam be buried? The burial demonstrates that: • A genuine birth occurred, • And the mother is now exempt from future Bechorah. It gives recognition to the fact that: This discharge counts as the mother's first offspring for the laws of Bechor. The Vlad Became Batel Rebbi Yochanan explains that there was indeed: • A small amount of actual Vlad, mixed together with: • A much larger amount of blood and other material. The Vlad is the minority. The other material is the majority. The minority Vlad becomes Batel B'Rov. Therefore, although there was enough of a Vlad to establish a previous birth: • The mixture does not convey Tumah in the normal way. A Shilya Without a Visible Vlad The Shilya in a House The Gemara brings a similar case. A woman delivers a: • Shilya – placenta, but no recognizable baby is found. The Tanna Kamma says: • The house becomes Tamei. Why? Not because the Shilya itself is a Vlad, but because: • Ein Shilya B'lo Vlad – a placenta does not normally exist without there having been a fetus. Therefore: We assume that a Vlad was present. Rebbi Shimon – The Vlad Dissolved Rebbi Shimon disagrees. He says: • The house remains Tahor. The Vlad may have: • Dissolved, • Mixed into the Shilya, • And become Batel in the majority. This is similar to the Chararas Dam, where the small amount of Vlad becomes Batel within the larger mass. Tumah of a Miscarried Fetus Tumah Beluah The Gemara discusses a woman carrying a fetus that died before birth. As long as it remains completely inside her: • The Tumah is Tumah Beluah – swallowed or enclosed Tumah. Therefore: • It does not make the entire house Tamei. But once the womb opens sufficiently: The Tumah can begin to affect the house. How Large Must the Opening Be? The Gemara gives a Shiur based on: • A Pika – a rounded bundle or spindle - related measure. Several different sizes of Pika are discussed. These measurements were familiar from: • Wool, • Spinning, • Weaving, • And the different thicknesses of thread. The size required depends on: • The particular case being measured. Different Sizes for Different Cases The Gemara discusses different Shiurim, including: • A smaller Pika associated with finer thread, • A larger one associated with thicker material. Different measurements apply to: • A human fetus, • An animal fetus, • And other areas of Tumah. The Gemara carefully distinguishes between the different practical Shiurim rather than treating every Pika as the same size. Gush from a Beis HaPras One of the larger measurements is relevant to: • A Gush – a clump of earth from a Beis HaPras. A Beis HaPras is a field where: • A grave was plowed, • And bones may have been scattered through the soil. A sufficiently large clump of earth must therefore be treated with concern for: • Tumah. Tzir and Tumah The Case of Fish Brine The Gemara moves to another Sugya involving: • Tzir – fish brine. The question concerns brine belonging to someone whose food has a status of Tumah. Tzir can contain: • The actual fish liquid, • Together with added water. The amount of water becomes extremely important. The Seven Liquids Only certain liquids are normally Mekabel Tumah. Water is one of them. But fish brine itself: • Is not one of the standard seven liquids. Therefore, if the water is only a minority within a larger quantity of Tzir: The water can become Batel to the brine. Hashakah Water that is Tamei can be purified through: • Hashakah. The Tamei water is brought into contact with: • Mikvah water. Through this contact: • The water becomes Tahor. The Gemara therefore analyzes whether the water contained within the Tzir: • Requires Hashakah, • Is already Batel, • Or can later regain significance. Can Something That Became Batel “Wake Up” Again? The Minority Water Became Batel Imagine a mixture containing: • A large amount of Tzir, • And a small amount of Tamei water. The water is the minority. Therefore: • It becomes Batel to the Tzir. At this point: The small amount of water no longer creates Tumah in the mixture. What If More Water Is Added Later? Now suppose the Tzir is poured into: • A pot containing a large quantity of water. The original small amount of water can now combine with: • The new water. The question is: Can the original water that was Batel now “wake up” and regain its previous status? This introduces the major concept that the Gemara will continue discussing: • Whether something that became Batel can later re - emerge when circumstances change. Terumah Falling into Chullin One Part Terumah in One Hundred The Gemara brings a related case. One piece of Terumah falls into: • One hundred pieces of Chullin. With the required ratio: • The Terumah becomes Batel. But there is still a monetary issue: • The Kohen originally owned the Terumah. Rebbi Eliezer – Remove One Rebbi Eliezer says: • One piece should be removed. We treat that piece as though: • It is the Terumah that originally fell in. The remainder can then be eaten. This also ensures that the Kohen's financial entitlement is addressed. The Chachamim – It Is Batel The Chachamim say: • The Terumah has become Batel in the mixture. However, the mixture must be eaten in a way that does not allow the Terumah component to regain significance. The gemorah describes methods such as eating the mixture: • Dry, • Roasted, • Kneaded with fruit juice, • Or divided into small portions. The concern is that the Batel Terumah should not later recombine in a way that creates a new prohibition. The Connection to Our Sugya This brings us back to the central issue. We have something that originally had its own status: • The Vlad, • The water, • Or the Terumah. It then became: • Batel within a majority. The question is: Once something has become Batel, can a later change cause its original status to return? This issue will continue into the next Daf. Key Chazarah • Rebbi Eliezer ben Yaakov says a Chararas Dam exempts an animal from future Bechorah. • The Chararas Dam is buried but does not convey Tumah through Maga or Masa. • Rebbi Yochanan explains that the small amount of Vlad becomes Batel within the majority of other material. • A Shilya normally indicates that there was a Vlad. • Rebbi Shimon says the Vlad may have dissolved and become Batel, leaving the house Tahor. • A fetus completely inside its mother is Tumah Beluah and does not make the house Tamei. • Once the womb opens to the required Shiur, the Tumah can emerge. • The Gemara discusses several sizes of Pika for different Tumah measurements. • Tzir itself is not one of the standard seven liquids that are Mekabel Tumah, while water is. • A minority of Tamei water can become Batel within a majority of Tzir. • The Gemara asks whether that water can later regain significance when more water is added. • A similar question appears when Terumah becomes Batel in Chullin. • The central issue is whether something that was Batel can later “wake up” and regain its original status.
